The Mobile Homes Act 2013 (Commencement No. 2) (England) Order 2020

The Secretary of State, in exercise of the powers conferred by section 15(2) of the Mobile Homes Act 2013¹, makes the following Order:

1 Citation¶

This Order may be cited as the Mobile Homes Act 2013 (Commencement No. 2) (England) Order 2020.

2 Provision coming into force on 15th June 2020¶

Section 8 (requirement for manager of site to be fit and proper person) of the Mobile Homes Act 2013 comes into force on 15th June 2020.

EXPLANATORY NOTE¶

(This note is not part of the Order)

This Order brings into force section 8 of the Mobile Homes Act 2013 (“the Act”) on 15th June 2020. That section is the last remaining provision of the Act to be commenced.

Section 8 of the Act inserts new sections 12A to 12E into the Caravan Sites and Control of Development Act 1960 (c. 62).

Section 12A provides that the Secretary of State may by regulations prohibit the use of land as a residential mobile home site unless the local authority is satisfied that the occupier or a person appointed to manage the site is a fit and proper person to manage the site.

Sections 12B to 12E give the Secretary of State the power, by regulations, to make related provision as to matters to be taken into account by local authorities in making a fit and proper person assessment, the establishment of a fit and proper person register, the procedure for applications and enforcement, including the creation of criminal offences.
