The Haulage Permits and Trailer Registration Act 2018 (Commencement) Regulations 2018

The Secretary of State, in exercise of the power conferred by section 27(2) of the Haulage Permits and Trailer Registration Act 2018¹, makes the following Regulations:

1 Citation¶

These Regulations may be cited as the Haulage Permits and Trailer Registration Act 2018 (Commencement) Regulations 2018.

2 Provisions coming into force on 1st January 2019¶

The following provisions of the Haulage Permits and Trailer Registration Act 2018 come into force on 1st January 2019—

a section 6 (production of permits and inspection of vehicles);

b section 7 (prohibition notices); and

c section 8 (offences: breach of regulations etc).

EXPLANATORY NOTE¶

(This note is not part of the Regulations)

These Regulations bring into force sections 6, 7 and 8 of the Haulage Permits and Trailer Registration Act 2018, the only provisions of that Act not commenced on Royal Assent. The remaining provisions of that Act are already in force.

Section 6 entitles an examiner to exercise powers set out in that section to enforce regulations made under section 1(1) of that Act. These include powers to require the production of an international road transport permit and to inspect and detain a vehicle to check that the use of the vehicle does not breach those regulations. Section 7 provides an examiner with a power to prohibit a vehicle from leaving the United Kingdom where a vehicle is being used contrary to regulations made under section 1(1) of that Act. Section 8 creates offences relating to breaches of regulations made under section 1(1) of that Act, and relating to sections 6 and 7 of that Act, which are brought into force by these Regulations.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
