The Social Security (Personal Independence Payment) Regulations 2013
Made25th February 2013
Coming into force in accordance with regulation 1(2)
The Secretary of State for Work and Pensions, in exercise of the powers conferred by sections 77(3), 78(3) and (4), 79(3) and (4), 80(1), (2), (3), (4) and (5)(a) and (c), 81(1), (3)(b) and (4), 83(3), 85(1), (5) and (6), 86(1) and (3), 87, 92(1) and 94(1), (2), (3)(a) and (4) of the Welfare Reform Act 2012 F1, makes the following Regulations.
A draft of this instrument has been laid before, and approved by a resolution of, each House of Parliament pursuant to section 94(6) of that Act.
These Regulations are made under the provisions of that Act and are made before the end of a period of 6 months beginning with the coming into force of those provisions F2.
PART 1 General¶
I11 Citation and commencement¶
I22 Interpretation¶
In these Regulations—- “the 1998 Act” means the Social Security Act 1998F4;
- “the Act” means the Welfare Reform Act 2012;
- “adult disability payment” has the meaning given in regulation 2 of the Disability Assistance for Working Age People (Scotland) Regulations 2022;
- “aid or appliance”—
- means any device which improves, provides or replaces C's impaired physical or mental function; and
- includes a prosthesis;
- “assessment” means the assessment referred to in regulation 4;
- “C” means a person who has made a claim for or, as the case may be, is entitled to personal independence payment;
- “child disability payment” has the meaning given in regulation 2 of the Disability Assistance for Children and Young People (Scotland) Regulations 2021;
- “component” means the daily living component or, as the case may be, the mobility component of personal independence payment;
- “descriptor” means a descriptor in column 2 of the tables in Parts 2 and 3 of Schedule 1;
- “disability living allowance” means disability living allowance under section 71 of the Social Security Contributions and Benefits Act 1992F5;
- “medical treatment” means medical, surgical or rehabilitative treatment (including any course or diet or other regimen), and references to a person receiving or submitting to medical treatment are to be construed accordingly;
- “prescribed date” means the date prescribed F6 by regulation 14, 15 or 15A , 15A or 15B;
- “previous award” means an award of either or both components to which C has ceased to be entitled;
- “the residence change date”, in relation to a person, means the date on which the person becomes permanently resident in Scotland (whether or not the Secretary of State is notified of the move and whether or not any such notification takes place before or after the person moves to Scotland);
- “revised” means revised under section 9 of the 1998 Act, and “revision” is to be construed accordingly;
- “run-on period” has the meaning given in regulation 23ZB(4);
- “Scottish adult disability living allowance” has the meaning given in regulation 2 of the Disability Assistance (Scottish Adult Disability Living Allowance) Regulations 2025;
- “superseded” means superseded under section 10 of the 1998 ActF7, and “supersession” is to be construed accordingly; and

PART 4 Residence and presence conditions¶
I1616 Conditions relating to residence and presence in Great Britain¶
Subject to the following provisions of this Part, the prescribed conditions for the purposes of section 77(3) of the Act as to residence and presence in Great Britain are that on any day for which C claims personal independence payment C—16A Meaning of “the relevant area” in this Part¶
In this Part, “the relevant area” means—I1717 Absence from Great Britain¶
I1818 Absence from Great Britain to receive medical treatment¶
18A Absence where His Majesty’s Government provides public information to advise British nationals to leave a country or territory or arranges the evacuation of British nationals from a country or territory¶
18B Time limits on absences where the claimant is treated as being in Great Britain¶
Where a person is temporarily absent from Great Britain in the circumstances specified in regulation 17(1), 18(1) or 18A(1), the total period of an absence where C is treated as present in Great Britain the relevant area will not exceed 26 weeks.18C Absence where His Majesty’s Government provides public information to advise British nationals to leave a country or territory or arranges the evacuation of British nationals from a country or territory¶

I1919 Absence from Great Britain in special cases¶
- “aircraft worker” means a person who is employed under a contract of service either as a pilot, commander, navigator or other member of the crew of any aircraft, or in any other capacity on board any aircraft where–
- the employment in that other capacity is for the purposes of the aircraft or its crew or of any passengers or cargo or mail carried on that aircraft; and
- the contract is entered into in the United Kingdom with a view to its performance (in whole or in part) while the aircraft is in flight,
- “mariner” means a person who is in employment under a contract of service either as a master or member of the crew of any ship or vessel, or in any other capacity on board any ship or vessel where –
- the employment in that other capacity is for the purposes of that ship or vessel or the crew or any passengers or cargo or mail carried by the ship or vessel; and
- the contract is entered into in the United Kingdom with a view to its performance (in whole or in part) while the ship or vessel is on voyage,
I2020 Serving members of Her Majesty's forces and their family members – further provision¶
C is treated as habitually resident in Great Britain for the purposes of regulation 16(c) where—20A Absence from England and Wales whilst present in Scotland¶
Where C is required for the purposes of regulation 16(a) to be present in England and Wales, even though C is absent from England and Wales on a particular day, C is to be treated as though they were present in England and Wales on that day if—I2121 Terminal illness¶
Where C is terminally ill and makes a claim for personal independence payment expressly on that ground, regulation 16 applies as if paragraph (b) were omitted.I2222 Persons residing in Great Britain to whom a relevant EU Regulation applies¶
Regulation 16(b) does not apply in relation to a claim for personal independence payment where on any day–I2323 Persons residing in an EEA state F62... or in Switzerland to whom a relevant EU Regulation applies¶

- Condition AThe person was residing in a country or territory outside Great Britain immediately before His Majesty’s Government—
- provided public information to advise British nationals to leave that country or territory, or
- arranged the evacuation of British nationals from that country or territory.
- Condition BThe person has left that country or territory.
- Condition CThe person arrived in Great Britain in the first 26 weeks beginning on the day on which the public information is issued, or the evacuation is started.
- Condition DThe person—
- has a right of abode in the United Kingdom within the meaning given in section 2 of the Immigration Act 1971,
- does not require leave to enter or remain in the United Kingdom in accordance with section 3ZA of that Act,
- has leave to enter or remain in the United Kingdom in accordance with immigration rules made under section 3(2) of that Act, or
- has leave on a discretionary basis outside of rules made under section 3(2) of that Act; or

- “NHS trust” means a body established under section 18 of the National Health Service (Wales) Act 2006; and
- “Local Health Board” means a body established under section 11 of that Act.

PART 1 INTERPRETATION¶
- “aided” means with –
- the use of an aid or appliance; or
- supervision, prompting or assistance;
- “assistance” means physical intervention by another person and does not include speech;
- “assistance dog” means a dog trained to guide or assist a person with a sensory impairment;
- “basic verbal information” means information in C's native language conveyed verbally in a simple sentence;
- “basic written information” means signs, symbols and dates written or printed standard size text in C's native language;
- “bathe” includes get into or out of an unadapted bath or shower;
- “communication support” means support from a person trained or experienced in communicating with people with specific communication needs, including interpreting verbal information into a non-verbal form and vice versa;
- “complex budgeting decisions” means decisions involving –
- calculating household and personal budgets;
- managing and paying bills; and
- planning future purchases;
- “complex verbal information” means information in C's native language conveyed verbally in either more than one sentence or one complicated sentence;
- “complex written information” means more than one sentence of written or printed standard size text in C's native language;
- “cook” means heat food at or above waist height;
- “dress and undress” includes put on and take off socks and shoes;
- “engage socially” means –
- interact with others in a contextually and socially appropriate manner;
- understand body language; and
- establish relationships;
- “manage incontinence” means manage involuntary evacuation of the bowel or bladder, including use a collecting device or self-catheterisation, and clean oneself afterwards;
- “manage therapy” means undertake therapy, where a failure to do so is likely to result in a deterioration in C’s health;
- “medication” means medication to be taken at home which is prescribed or recommended by a registered –
- doctor;
- nurse; or
- pharmacist;
- “ monitor a health condition ” means –
- detect significant changes in C's health condition which are likely to lead to a deterioration in C's health; and
- take action advised by a –
- registered doctor;
- registered nurse; F115...
- health professional who is regulated by the Health Professions Council ; or
- a physician associate registered under the Anaesthesia Associates and Physician Associates Order 2024,
without which C's health is likely to deteriorate;
- “orientation aid” means a specialist aid designed to assist disabled people to follow a route safely;
- “prepare”, in the context of food, means make food ready for cooking or eating;
- “prompting” means reminding, encouraging or explaining by another person;
- “psychological distress” means distress related to an enduring mental health condition or an intellectual or cognitive impairment;
- “read” includes read signs, symbols and words but does not include read Braille;
- “simple budgeting decisions” means decisions involving –
- calculating the cost of goods; and
- calculating change required after a purchase;
- “simple meal” means a cooked one-course meal for one using fresh ingredients;
- “social support” means support from a person trained or experienced in assisting people to engage in social situations;
- “stand” means stand upright with at least one biological foot on the ground;
- “supervision” means the continuous presence of another person for the purpose of ensuring C's safety;
- “take nutrition” means –
- cut food into pieces, convey food and drink to one's mouth and chew and swallow food and drink; or
- take nutrition by using a therapeutic source;
- “therapeutic source” means parenteral or enteral tube feeding, using a rate-limiting device such as a delivery system or feed pump;
- “therapy” means therapy to be undertaken at home which is prescribed or recommended by a—
- registered –
- doctor;
- nurse; F117...
- pharmacist; or
- a physician associate; or
- health professional regulated by the Health Professions Council;
but does not include taking or applying, or otherwise receiving or administering, medication (whether orally, topically or by any other means), or any action which, in C’s case, falls within the definition of “monitor a health condition - “toilet needs” means –
- getting on and off an unadapted toilet;
- evacuating the bladder and bowel; and
- cleaning oneself afterwards; and
- “unaided” means without –
- the use of an aid or appliance; or
- supervision, prompting or assistance.
