The Care Quality Commission (Registration) Regulations 2009

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 10(2), 13(1), 16(a), 17(1), 20, 30(3), 39(1) and (4), 41(1), 42, 65(1) and (3), 89 and 161(3) and (4) of the Health and Social Care Act 20081.
In accordance with section 20(8) of the Act, the Secretary of State has consulted such persons as he considers appropriate.
PART 1 GENERAL¶
I11 Citation and commencement¶
These Regulations may be cited as the Care Quality Commission (Registration) Regulations 2009 and shall come into force on 1st April 2010.I52 Interpretation¶
In these Regulations—- “the Act” means the Health and Social Care Act 2008;
- “health service body” means an English NHS body2, or NHS Blood and Transplant;
- “local authority” has the same meaning as in section 2B of the National Health Service Act 2006;
- “registered manager” means, in respect of a regulated activity, a person registered with the Commission under Chapter 2 of Part 1 of the Act as a manager in respect of that activity;
- “registered person” means, in respect of a regulated activity, the person who is the service provider or a registered manager in respect of that activity;
- “relevant address” means—
- where the service provider is registered to carry on the regulated activity to which the enforcement action relates from one address, that address; or
- where the service provider is registered to carry on the regulated activity from more than one address, any of those addresses to which the enforcement action is relevant;
- “service provider” means, in respect of a regulated activity, a person registered with the Commission under Chapter 2 of Part 1 of the Act as a service provider in respect of that activity;
- “service user” means a person who receives services provided in the carrying on of a regulated activity.
