The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 116(2) and (3)(a) and (b) of the Victims, Witnesses, and Justice Reform (Scotland) Act 20251.

1 Citation, commencement and interpretation

1 These Regulations may be cited as the Victims, Witnesses, and Justice Reform (Scotland) Act 2025 (Commencement No. 2 and Saving Provisions) Regulations 2026 and come into force on 19 March 2026.
2 In these Regulations—
  • the 1995 Act” means the Criminal Procedure (Scotland) Act 19952,
  • the Act” means the Victims, Witnesses, and Justice Reform (Scotland) Act 2025.

2 Appointed days

1 The day appointed for the coming into force of the provisions of the Act specified in column 1 of the table in the schedule (the subject matter of which is described in column 2 of that table) is specified in column 3 of that table.
2 Where a purpose is specified in column 4 of the table in the schedule in relation to any provision specified in column 1 of that table, that provision comes into force on the day appointed only for that purpose.

3 Saving provision: circumstances in which non-harassment order must be considered by court

The amendments to the 1995 Act, effected by section 107 (circumstances in which non-harassment order must be considered by the court) of the Act, do not apply to offences for which an accused person was convicted prior to 1 September 2026.

4 Saving provision: non-harassment orders: domestic abuse cases

The amendments to the 1995 Act, effected by section 108 (non-harassment orders: domestic abuse cases) of the Act, do not apply to offences for which an accused person was convicted prior to 1 September 2026.
