The Department of Health makes the following Regulations, in exercise of the powers conferred by Articles 6, 7(2)(b), 10(1B) and (3), 11(1A) and (1B) and 15(1) of, and paragraphs 5, 8 and 18 of Schedule 1 to, the Smoking (Northern Ireland) Order 20061.

4 Fixed Penalties¶
An authorised officer of an enforcement authority who has reason to believe that a person has committed an offence under Article 9(3) of the Order in relation to a vehicle that is smoke-free by virtue of regulation 12(1A) of the Smoke-free (Exemptions, Vehicles, Penalties and Discounted Amounts) Regulations (Northern Ireland) 2007, may give that person a penalty notice in respect of the offence.5 Enforcement¶
