Wildlife Management and Muirburn (Scotland) Act 2024
2024 asp 4An Act of the Scottish Parliament to make provision for the management of wildlife through the prohibition of glue traps and snares and regulation of other wildlife traps and the licensing of land on which certain birds are to be killed or taken; and for the licensing of the making of muirburn; and for connected purposes.

The Bill for this Act of the Scottish Parliament was passed by the Parliament on 21st March 2024 and received Royal Assent on 30th April 2024
Part 1 Wildlife management¶
Glue traps¶
I11 Offence of using glue trap¶
.
-
“authorised person” means a person—
-
authorised by the scheme made under section 5, and
-
acting in accordance with the person’s authorisation,
-
-
“glue trap” means a trap that—
-
is designed, or is capable of being used, to catch an animal other than an invertebrate, and
-
uses an adhesive substance as the means, or one of the means, of capture.
-
I22 Offence of supplying glue trap¶
-
“authorised person” has the meaning given in section 1(7),
-
“glue trap” has the meaning given in section 1(7),
-
“supply” of a glue trap includes—
-
selling it,
-
exchanging it for a consideration other than money,
-
giving it as a prize or otherwise making a gift of it,
-
otherwise making the glue trap available.

I33 Offence of possessing glue trap¶

“authorised person” has the meaning given in section 1(7),
-
“glue trap” has the meaning given in section 1(7).
I44 Forfeiture and disposal of glue traps¶

“chief constable” has the same meaning as in section 99(1) of the Police and Fire Reform (Scotland) Act 2012,

“constable” has the same meaning as in section 99(1) of the Police and Fire Reform (Scotland) Act 2012,

“glue trap” has the meaning given in section 1(7).

“Muirburn Code” is to be construed in accordance with section 18(1) and includes any supplementary material,

“muirburn licence” has the meaning given in section 14(4),

“muirburn season” is to be construed in accordance with section 20(1),

“peat” means soil which has an organic content (that is, content consisting of living and dead plant and animal material) of more than 60%,
