Short-term Leases (Disclosure of Information) Bill [HL]

A bill to Confer powers on local authorities to require information from short-term rental property owners.

Be it enacted by the King’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Local Authorities: information provided by short-term rental providers

(1) The Secretary of State may by regulations made by statutory instrument allow local housing authorities in England to require all owners of short-term rental properties in their area to provide occupancy data and other information to the relevant local housing authority.
(2) If a short-term rental property is let by a management company or visitor accommodation provider on behalf of the property owner, the regulations may allow local housing authorities to require the company or provider to provide data in accordance with sections 2 and 3 of this Act on behalf of the property owner.

2 Information requirements on owners of short-term rental properties

(1) Regulations made under section 1 must allow local housing authorities to require that owners of short-term rental properties provide information to the relevant local housing authority detailing, for each calendar year—
(a) the total number of nights that the advertised short-term rental property has been occupied by short-term tenants;
(b) in each instance of an occupancy, the number of nights occupied and to whom the property was let.
(2) Regulations made under section 1 may allow local housing authorities to require that any information required from owners of short term rental properties under this Act must be received by the local housing authority before any short-term rental listings may be advertised on any online platform.

3 Additional information requirements on owners of short-term rental properties advertised on online platforms

Regulations made under section 1 may allow local housing authorities to require, for any short-term rental properties advertised on an online booking platform, that the property owner must provide to the local housing authority—
(a) the details of the online booking platform where the short-term let was advertised, and
(b) the total number of nights that the property has been let through bookings made on each such online platform.

4 Regulations

A statutory instrument containing regulations under this Act may not be made unless a draft of the instrument has been laid before, and approved by a resolution of, each House of Parliament.

5 Interpretation

In this Act—
local housing authority has the meaning given by section 261 of the Housing Act 2004;
short-term rental property means—
(a) a dwelling-house let for the purpose of conferring on the tenant the right to occupy the dwelling-house for no more than 90 days in a calendar year, or
(b) any part of a dwelling-house let for the purpose of conferring on the tenant the right to occupy that part of the dwelling-house for no more than 90 days in a calendar year.

6 Extent, commencement and short title

(1) This Act extends to England and Wales.
(2) This Act comes into force on the day on which it is passed.
(3) This Act may be cited as the Short-term Leases (Disclosure of Information) Act 2026.
